Cluck & Coop Messaging Terms & Conditions

Cluck & Coop (hereinafter, "Cluck & Coop," "We," "Us," "Our") offers a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and the Messaging Privacy Policy.

By opting into or participating in the Program, you accept and agree to these terms and conditions, including the resolution of disputes through binding, individual-only arbitration, as detailed in the "Dispute Resolution" section below. Arbitration may limit discovery and appellate review compared to court. Please review carefully.

By opting into the Program, you confirm your genuine interest in receiving discounts, promotions, and updates from Us. If your intent is to initiate litigation or bring legal claims, you must immediately unsubscribe using the instructions below and agree to indemnify Us and our service providers for expenses, including attorneys’ fees, incurred in defending against such claims.

This Agreement applies exclusively to the Program and does not modify other terms, conditions, or privacy policies governing your relationship with Cluck & Coop in other contexts.


1. User Opt-In

  • Consent to Receive Messages: By providing your phone number, you agree to receive recurring automated promotional and personalized marketing messages (e.g., SMS and MMS) from Cluck & Coop, including messages sent via an automated telephone dialing system. Consent to receive text messages is not a condition of purchase. Standard message and data rates may apply, and message frequency may vary.
  • Consent to Electronic Information: By opting in, you consent to receive relevant legal information electronically. You may request paper copies by emailing support@cluckandcoop.com.
  • Data Disclosure to Prevent Fraud: You authorize Us, our wireless carrier, or service providers to use or disclose information about your account or device to help prevent fraud and verify your identity.

2. User Opt-Out

To stop receiving messages, reply with any of the following keywords: STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT. You may receive a final confirmation message. Other methods, such as misspelled keywords or verbal requests, may not be processed. Contact customer support at info@cluckandcoop.com if you have issues opting out.


3. Program Description

Participants may receive:

  • Marketing, promotions, and exclusive offers.
  • Transactional updates (e.g., order confirmations, shipping updates).
  • Support messages or notifications related to cart reminders.

4. AI-Generated Content

Some messages may be generated using AI tools tailored to your interests. By participating in the Program, you agree to this and acknowledge that AI providers are not responsible for the messages sent.


5. Message Frequency and Costs

Message and data rates may apply. We reserve the right to adjust the frequency of messages sent. Daily, weekly, or monthly message volume will vary.


6. Support

For support, reply with "HELP" or email us at info@cluckandcoop.com. Note: Email is not a valid method to opt out of messages.


7. Disclaimer

The Program is offered "as is" and may not work in all areas or on all devices. Cluck & Coop is not responsible for delays or failures caused by wireless carriers.


8. Age Restriction

You must be 13 years or older to participate. If under 18, you need parental or guardian consent.


9. Prohibited Content

You may not send or engage with prohibited content through the Program, including but not limited to:

  • Fraudulent or harassing content.
  • Obscene, hateful, or discriminatory material.
  • Viruses or harmful code.
  • Unlawful promotions or content that violates applicable laws.

10. Compliance with State Telemarketing Laws

We comply with relevant telemarketing laws, including maintaining an internal Do Not Call list. To opt out, follow the instructions in Section 2.


11. Dispute Resolution

Binding Arbitration: Any disputes related to the Program will be resolved through arbitration in accordance with the Federal Arbitration Act. Class actions and jury trials are waived. Arbitration will be administered by New Era ADR under their Virtual Expedited Arbitration Rules.

Informal Dispute Resolution: Parties agree to attempt informal resolution before initiating arbitration. Submit written notice of disputes to info@cluckandcoop.com.


12. Miscellaneous

  • Changes to this Agreement will be communicated to you.
  • Continued participation after changes signifies acceptance of the revised terms.
  • Any provision deemed invalid will not affect the enforceability of remaining terms.

Appendix A: Do Not Call Policy

We comply with the Telephone Consumer Protection Act (TCPA) and related state laws. To be added to our internal Do Not Call list, reply with STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT or email info@cluckandcoop.com.

Your phone number will remain on the Do Not Call list indefinitely unless you provide express consent to rejoin the Program.
